Boat Without a Licence in Marbella: What Changed and What to Book Now

Updated October 19, 2026 · 5 min read

Two small open motorboats with canopies side by side on calm deep-blue sea

For most people, book a private boat with a skipper, such as the private boat tour from Puerto Banús with dolphin watching and drinks: it is rated 4.9 from 275 reviews, takes up to ten people, and fuel, drinks and music are in the price from €250. The reason is a rule change. Since 1 October 2026 Spanish law no longer lets a customer helm a rented boat without a qualification, so “no licence needed” now means someone else drives.

What changed on 1 October

Spain used to allow anyone to steer a motor boat of up to 5 metres and 15 horsepower without a title. Royal Decree 1188/2025, published in the BOE on 30 December 2025, changed Article 10 of Royal Decree 875/2014 with effect from 1 October 2026. Its preamble says the exemption is now limited to private and sporting use, and that when such boats are rented, the renter must hold the corresponding title. The stated reason is the number of incidents and accidents in these activities.

For Marbella that has two consequences. The classic “rent a small boat and drive it yourself” product no longer fits the exemption, and anything that puts a skipper at the helm is a different product that the change is not aimed at. We have read the BOE text, not the operators’ contracts, so treat what follows as a reason to ask questions, not as legal advice.

The self-drive listing, and why to ask first

The Boat Rental without Licence listing is still on sale. The booking page gives Puerto Banús as the start, while the listing’s short description speaks of a rental from Málaga, so confirm the meeting point before booking. It is priced from €60 for a group of up to 6, and has the lowest rating of the boats here (4.2 from 51 reviews). Its booking page describes a 5-metre, 15 hp trimaran, a short tutorial from an instructor, staff who take the boat out of and back into its mooring, and a €200 deposit returned after inspection. Fuel is not included, and neither are food, drinks or hotel pick-up. People over 70 or 120 kg and people with mobility impairments are listed as not suitable, and alcohol is not allowed.

Two things need checking before you pay. Its “know before you go” section still quotes the old exemption, with the 4.5 to 5 metre length and 15 hp, which is exactly what the BOE text restricted. And the page is unclear about duration: the data says 30 minutes, the description speaks of 1 to 4 hours. Ask the operator in writing whether the boat will really be handed to you without a licence from now on, and what the €60 covers. Free cancellation up to 24 hours in advance is shown on the page.

The skippered options

Private boat with dolphin watching. This is the one with real evidence behind it: 275 reviews, 4.9. It leaves from Puerto Banús (meeting point on Calle Mlle. Ribera, Nueva Andalucía), runs 1 to 5 hours and takes up to ten. The page lists the boat, fuel, drinks, music and insurance as included; premium drinks, food and a photographer are extra. Dolphins are not guaranteed, as the listing itself says.

Marbella Wave. Two listings from the same operator, a skippered boat rental for up to 6 (€195, 2 to 4 hours) and a Sea Ray boat for up to 8 (€180, 1 to 4 hours). Both start at the Puerto Deportivo Virgen del Carmen in Marbella itself. The skipper, fuel for the booked time and the boat are included; extra fuel if you overrun and drinks and snacks are not. The usual route runs along the Golden Mile to Puerto Banús with a swim stop. Neither listing has reviews yet, which is the honest reason they are not our first pick.

Private rental with skipper and donut. This listing is from €280 for up to 7 and has 5.0 from 8 reviews. It includes a skipper, fuel, one welcome drink and snacks. The page contradicts itself on whether the donut ride and paddle board come from two or three hours, and says prices are per hour, so confirm the total. People prone to seasickness are listed as not suitable.

If you only want to swim and see dolphins and nobody in the group wants to steer, the skippered boats cost more per boat but spare you the fuel, the deposit and the question mark over the rules. If you want a set departure with other people instead, our guide to sunset sailing from Puerto Banús compares the shared options, and the private tours page lists the rest.

Bring a passport or ID card (the Marbella Wave pages accept a copy), sunscreen, a hat and swimwear. Our pick for most people remains the private boat tour from Puerto Banús.
